[論文摘要] 古英語詞(archaic word)在現代英語中雖已不再廣泛應用,且正在逐漸消亡，但在英語、合同英語中卻仍較常見，如副詞here, there, where加上一個或幾個介詞構成的副詞，這類古詞語的運用可使合同簡練、嚴密、莊重，且具有很強的文體效果，但同時也爲初次接觸英語合同者帶來了極大困難，本文將對這些詞進行說明，以使初學者初步瞭解對外經貿合同的英語用詞特點。
隨着我國改革開放的進一步深化，領域的國際交往日趨頻繁，經濟合作更加密切，國際間的經濟活動，如貿易、、、經濟合作等都離不開合同。但我們也發現，在經貿活動中出現了不少涉外經濟糾紛，這些糾紛發生的頻率越來越高，其中不少糾紛在很大程度上是由合同文字引起的，要避免這些糾紛的發生，首先就需要讀懂合同原文。合同檔案枯燥、乏味，句子長、術語多，另外一個難點是這些英文合同中包含大量的舊體詞，這些舊體詞在現代英語中已很少使用，但在合同文字中卻很常見，主要是爲了避免重複、避免誤解、避免歧義，使行文準確、簡潔，這些詞各有各的含義，但由於篇幅所限，筆者只選擇其中幾個進行詳細說明，以使初學者初步瞭解對外經貿合同的英語用詞特點。
一、以here開頭的詞
by
該詞意爲by means of , by reason of this, by this agreement，“特此”，“因此”，“茲”，“在此”。此詞常用作法律、經貿檔案、合同、協議書等正式檔案的開頭語，在合同條款中需特別強調時也可用，表示當事人藉此合約，要宣示某種具有法律效力的“意思表示”，如保證、同意、放棄權利等，一般放於主語後，緊鄰主語。如：The Company hereby covenants and warrants that…… 意爲：By this agreement the Company covenants and warrants that……即：公司在此保證……再如：Both parties hereby agree that……意爲：By this agreement both parties agree that……即：雙方當事人在此同意……
of
該詞意爲：of this agreement，“關於此點”；“在本檔案中”，表示上文已提及的“本合同的、本檔案的……”，一般置於要修飾的名詞的`後面，與之緊鄰。如：to take effect on the date hereof 意爲：to take effect on the date of this agreement 即：於本合約之日期生效。再如：the headings of the sections hereof 意爲：the headings of the sections of this agreement 即：本合約各條款之標題。
to
該詞意爲：to this agreement，“至此”，“在此”，表示上文已提及的“本合同的……本檔案的……”，一般置於要修飾的名詞的後面，與之緊鄰。如：both parties hereto 意爲both parties to this agreement，即本合約之當事人雙方；items specified in Attachment I and hereto 意爲：items specified in Attachment I to this agreement 即：本合約之附件I所列之各項。
