摘 要
審前準備是審判程序中的1個相對獨立的訴訟程序階段，有其獨立的'價值。該程序階段完結有其相應的訴訟法律後果，對後來的判決結果有重要影響，審前準備內含着整理案件爭點、固定案件證據、保障開庭審判、提高庭審效率等功能，但從立法和司法的現狀看來，該程序所存在的缺陷也是不容忽視的，因此應對審前準備程序給予特別關注，就與之相關的若干問題展開論述。

ABSTRACT
The civil pre-trial preparation procedure is a relative independent course in a unitary litigation. It has its own value and litigation results. The civil pre-trial preparation produce has the function of regulating disputation, fixing evidence, guaranteeing hearings and enhancing the efficiency of a case. But from the present situation of legislation and jurisdiction, it also has some flaw. So it is very important to pay close attention to the civil pre-trial preparation procedure and make expound of it.
