A house bought by parents and registered under their child’s name remains the personal property of the child even after the child gets married, according to a judicial explanationissued by China’s Supreme People’s Court.
根據最高人民法院發佈的司法解釋，父母爲子女購買房產且產權登記在自己子女名下的，即使在子女婚後仍屬於其個人財產。
報道中的judicial explanation就是“司法解釋”，簡單說來，就是由the Supreme Court（最高法院）對具體適用法律的問題做出的解釋。
這次的Marriage Law（婚姻法）第19條stipulation（條款、規定）的.司法解釋意思是說如果父母爲兒子或女兒購買了real estate（房產），當兒女結婚後，這套房子不算作是小夫妻倆的mutual property（共同財產），而只能算作是購買那一方的personal property（個人財產）。而若這套房子是兩方父母共同購買的，而最後雙方end in divorce（最後離婚），那麼，將根據兩方父母的出資額來分割財產，由此避免房產購買方的loss of family property（家庭財產損失）。
有的人還在婚前簽訂prenuptial agreement（婚前協議），規定離婚後雙方財產的歸屬，但這難免會傷害到夫妻雙方的感情。而這次《婚姻法》的司法解釋，對很多人來說算是一個welcome relief（可喜的安慰）。
